1. Definition and object of the contract

This contract (hereafter: “Contract“) is for the sale of gift items, gifts and home furnishings (hereafter: “Goods“) through the website www.omniasacra.com (hereafter: “Site”)

The Contract is concluded between PALANO SRLS (hereinafter: “Omnia Sacra”) with its registered office at Via San Filippo Bianchi no. 10, Messina, and the customer/consumer (hereinafter: “Customer“).

The General Terms and Conditions govern only the offer, acceptance, method of purchase, transmission, right of withdrawal, and terms under which the Goods are presented to the Customer prior to entering into the Contract.

  1. Recipients of the Contract

The Contract is intended for individuals over the age of 18, resident in Italy and who have previously registered with the Site. Registration on the Site is free and requires acceptance of the General Terms and Conditions of Sale, which if not accepted does not allow orders to be placed. The Customer warrants that the personal information provided during the Site registration process is complete and true. Customer agrees to hold OMNIA SACRA harmless from any indemnification obligation and/or penalty arising out of and/or in any way related to Customer’s violation of the Site registration rules.

  1. Mode of Purchase

To purchase one or more Goods offered on the Site, the Customer completes an order form (hereinafter: “Order“) in electronic format and sends it to OMNIA SACRA, electronically, following the instructions that will follow him in the different stages of the purchase; the contract is concluded when OMNIA SACRA registers the order form, after verification of the correctness of the data relating to the order and payment. Before proceeding with the transmission of the order, the Customer has the opportunity to correct any data entry errors. Once the order form has been registered and confirmation of authorization for payment of the total amount due has been received, OMNIA SACRA will send the Customer, via e-mail to the e-mail address provided, confirmation of the order and receipt of payment. It is recommended to keep the e-mail received as proof of purchase; the order form will be stored in OMNIA SACRA’s database for as long as necessary to process the order and, in any case, within the terms of the law. To access their order form, the Customer can consult the appropriate section of the Site where they will find a list of all orders placed.

Shipping charges, including VAT and packaging, are automatically calculated and reported by the system at the time of purchase.

Payment can be made through the PAYPAL system , bank transfer in advance.

Information on the characteristics of the product purchased, detailed indication of the price, the means of payment used, the procedures for exercising the right of withdrawal, shipping costs and any additional costs as well as an indication of the Customer Service, which the Customer can contact to request assistance and / or make complaints are indicated in the e-mail containing the confirmation of the order.

If the list prices differ from those communicated to the Customer, or if the products ordered are missing or incorrect with respect to those requested by the Customer, OMNIA SACRA undertakes to notify the Customer immediately, also informing him/her of the possibility of repeating the Order under the conditions indicated therein, as well as the right to withdraw from the Contract, in which case OMNIA SACRA will refund the total amount paid – consisting of the purchase price, shipping costs and any other additional cost – immediately, and, in any case within the term of thirty days from the day after the order was sent. Any delays in crediting may depend on the banking institution, type of credit card, or payment solution used. In any case, the value date of the re-credited amount will be the same as that of the debit.

  1. Delivery Method

OMNIA SACRA shall deliver the Goods to the address indicated by the Customer in the order form within five (5) business days, but no later than thirty (30) calendar days after the conclusion of the Contract.

In case of non-execution of the Order by OMNIA SACRA, due to the unavailability, even temporary, of the Goods, OMNIA SACRA shall immediately notify the Customer in the manner indicated in the preceding article and shall refund any sums paid by the same.

Unless the Customer consents, to be expressed prior to or during the conclusion of the Contract, OMNIA SACRA agrees not to perform a service other than that agreed upon, even if of equivalent value and quantity.

Delivery of the Goods is made on working days. In case of non-delivery due to the absence of the recipient at the address specified in the order form, the courier in charge will leave a card to certify the delivery attempt. The Customer should contact the courier at the phone number listed on the card to arrange a new delivery attempt. After two unsuccessful delivery attempts, the shipment will be considered “in storage” and the Customer must agree with Customer Service on a new delivery date by agreeing on a possible change of delivery address. In the event that the delivery attempt following the Customer Service contact also fails or in the event that the Customer does not respond to the Customer Service contact attempt, the package will be returned to OMNIA SACRA who will notify the Customer of this circumstance by e-mail. After thirty (30) days from when the package is returned to OMNIA SACRA, the contract shall be deemed terminated and the purchase order cancelled pursuant to Art. 1456 of the Civil Code. Upon termination of the contract, OMNIA SACRA will proceed to refund the total amount paid by the Customer less the cost of delivery of the product and any other expenses. In the event that, before the expiration of thirty days, the Customer requests to receive the purchased product again, OMNIA SACRA will proceed with the new delivery, after charging, in addition to the cost of the same, the cost of returning the product to OMNIA SACRA.

Upon delivery of the Goods, the Customer is required to check that the Goods are as ordered and are free from defects or flaws. Otherwise, it is obliged to report any problems encountered in the manner and within the timeframe stipulated in Articles 5 and 6.

  1. Omnia Sacra Gift Card

Omnia Sacra Gift Card is issued by Omnia Sacra Srls, Via San Filippo Bianchi, 10 98122 Messina (ME)

The Omnia Sacra Gift Card allows you to purchase, exclusively from the Omnia Sacra store and e-commerce platform at Omniasacra.com. The Omnia Sacra Gift Card cannot be used to purchase another Omnia Sacra Gift Card. No additional cost is charged for activation and use.

The Omnia Sacra Gift Card is issued and activated at the point of sale, upon payment by the customer, in cash or other payment methods accepted by the point of sale, of an amount in each case not less than 50.00 euros and not more than 999.00 euros. The loaded Omnia Sacra Gift Card counts as a scaled purchase voucher and, as a qualification, takes on the nature of a mere financial movement. The relevant amount paid will be VAT-free as the transaction is a supply of money.

After activation at the point of sale with the payment of the chosen amount, an issuance receipt will be given to the customer indicating the amount loaded. The amount loaded onto the Omnia Sacra Gift Card does not accrue interest.

Omnia Sacra Gift Card is a bearer security and is equivalent to cash. It is not convertible into money and cannot, under any circumstances, be made subject to return to Omnia with a request for refund of the amount loaded into it.

The Omnia Sacra Gift Card is reusable several times until the loaded credit is exhausted and in any case within one year from the issue date indicated on the card. After each expenditure, the credit will be automatically deducted, until the loaded amount is completely exhausted. If the amount of the Omnia Sacra Gift Card is not sufficient to cover the amount of the expense, you can supplement its use with other forms of payment accepted at the relevant store.

Responsibility for use and safekeeping is the sole responsibility of the Omnia Sacra Gift Card holder. In case of theft, loss, damage or loss, the Omnia Sacra Gift Card cannot be made the subject of a refund by Omnia Sacra. The point of sale reserves the right to reject all cards that it suspects in its discretion to have been counterfeited or photocopied.

The purchase and use of the Omnia Sacra Gift Card implies acceptance of these terms and conditions of use. Omnia Sacra reserves the right to modify and/or amend, at its discretion and at any time, these terms and conditions by giving notice by e-mail.   1. Returns and Deliveries Not Made

In cases where at the time of delivery the Goods are damaged in whole or in part or are different from what was ordered or delivery was not made, without prejudice to the provisions of Article 11 below, the Customer shall promptly inform Customer Service in the manner provided in Article 5 within thirty days of receipt of the Goods.

Specifically:

  1. Totally Damaged Goods: the Customer may decide at its discretion to ask OMNIA SACRA for a refund of the price paid or to ask for a full replacement of the Goods, at no additional cost.
  2. Partially Damaged Goods: the Customer may decide at his or her discretion to ask OMNIA SACRA for a refund of the price paid for the damaged Goods or a full replacement of the damaged Goods at no additional cost.
  3. Goods differing from those ordered: the Customer may decide at his or her discretion to ask OMNIA SACRA for a refund of the price paid after returning the Goods, or for a full replacement of the Goods at no additional cost, or for a replacement of only the differing Goods at no additional cost.
  4. Deliveries not made: the Customer may ask OMNIA SACRA for a full refund of the amount paid if OMNIA SACRA fails to meet the delivery deadline in Article 4.

In the above cases, if chosen by the Customer, Omnia Sacra agrees to refund, within thirty days, the price paid for the Order, including shipping costs.

  1. Right of Withdrawal

Subject to the provisions of Article 6, the Customer may withdraw from the Contract, without penalty and without charge, within 14 days of receipt of the Goods by sending a simple written notice to INFO@OMNIASACRA.COM

A Customer who intends to withdraw from the Contract must return all Goods to the address on the invoice within 14 days from the date he or she communicated his or her desire to withdraw. Shipping costs are placed at your expense.

In case of withdrawal, the Customer has the right to obtain a refund of the price paid including any shipping costs.

  1. Intellectual Property Rights

All rights in the Site and in all materials contained therein as well as in trademarks and/or distinctive signs and/or in any and all materials or content over which intellectual, industrial or any other property rights exist are exclusively owned by OMNIA SACRA and/or other parties and/or its licensors. No rights are given to the Client.

  1. Guarantees

All products sold on the Site are covered by the Legal Guarantee of Conformity provided by Legislative Decree no. 206/2005 (“Consumer Code”).

  1. Jurisdiction

The Contract is governed by Italian law. Any dispute relating to the application, execution, interpretation and breach of the Contract shall be within the jurisdiction of the Court of the Customer’s residence or domicile.

  1. Other forecasts. Limitations of liability

OMNIA SACRA cannot be held liable in any way for delays in the delivery of the Goods or non-delivery of the Goods if the delay or non-delivery was caused by exceptional and unforeseeable circumstances, such as civil unrest, intentional damage, fire, flood, storm, or supernatural events, outages of an ISP or telecommunications provider, related to the performance of the Contract.
