1. Definition and object of the contract

This agreement (hereinafter: “Contract”) has as its object the sale of objects, gift items and furnishing accessories (hereinafter: “Goods”) through the website www.omniasacra.com (hereinafter “Site”)

The Contract is concluded between PALANO SRLS (hereinafter: “Omnia Sacra”) with registered office in Via San Filippo Bianchi n. 10, Messina, and the customer//consumer (hereinafter: “Customer”).

The General Conditions exclusively regulate the offer, acceptance, methods of purchase, transmission, right of withdrawal and the terms with which the Goods are presented to the Customer before the stipulation of the Contract.

  1. Recipients of the Contract

The Contract is addressed to natural persons over 18 years of age, resident in Italy and who have previously registered on the Site. Registration on the Site is free and requires acceptance of the General Conditions of Sale which, if not accepted, will not allow orders to be placed. The Customer guarantees that the personal information provided during the registration procedure on the Site is complete and truthful. The Customer agrees to hold OMNIA SACRA harmless from any compensation obligation and/or sanction arising from and/or in any way connected to the violation by the Customer of the rules on registration on the Site.

  1. How to Purchase

To purchase one or more Goods offered on the Site, the Customer fills in the order form (hereinafter: “Order”) in electronic format and sends it to OMNIA SACRA, electronically, following the instructions that will follow in the various stages of the purchase; the contract is concluded when OMNIA SACRA registers the order form, after checking the correctness of the data relating to the order and the payment. Before proceeding with the transmission of the order, the Customer has the possibility of correcting any errors in the data entry. Once the order form has been registered and confirmation of the authorization to pay the total amount due has been received, OMNIA SACRA will send the Customer, via e-mail to the indicated e-mail address, the order confirmation and the payment receipt. It is recommended to keep the e-mail received as proof of purchase; the order form will be archived in the OMNIA SACRA database for the time necessary to process the order and, in any case, within the terms of the law. To access their order form, the Customer can consult the appropriate section of the Site where they will find the list of all the orders placed.

Shipping costs, including VAT and packaging, are automatically calculated and communicated by the system at the time of purchase.

Payment can be made through the system PAYPAL, advance bank transfer.

The information relating to the characteristics of the purchased product, the detailed indication of the price, the means of payment used, the methods for exercising the right of withdrawal, shipping costs and any additional costs as well as the indication of the Customer Service, to which the Customer can turn to request assistance and/or present complaints are indicated in the e-mail containing the order confirmation.

In the event of discrepancies between the list prices and those communicated to the Customer, or in the event of missing or inaccurate products ordered compared to those requested by the Customer, OMNIA SACRA undertakes to immediately notify the Customer, also informing him of the possibility of repeating the Order under the conditions indicated therein, as well as the right to withdraw from the Contract, in which case OMNIA SACRA will refund the total amount paid - consisting of the purchase price, shipping costs and any other additional costs - immediately, and in any case within thirty days from the day after sending the order. Any delays in crediting may depend on the banking institution, the type of credit card or the payment solution used. In any case, the value date of the re-credited amount will be the same as the debit.

  1. Delivery Methods

OMNIA SACRA delivers the Goods to the address indicated by the Customer in the order form within 5 working days and in any case no later than thirty (30) calendar days from the conclusion of the Contract.

In the event of failure to execute the Order by OMNIA SACRA, due to the unavailability, even temporary, of the Goods, OMNIA SACRA will immediately notify the Customer in the manner indicated in the previous article and will refund any sums paid by the Customer.

Unless the Customer consents, to be expressed before or during the conclusion of the Contract, OMNIA SACRA undertakes not to perform a service other than that agreed upon, even if of equivalent value and quantity.

The delivery of the Goods is carried out on working days. In the event of failed delivery due to the absence of the recipient at the address specified in the order form, the courier in charge will leave a card to certify the delivery attempt. The Customer must contact the courier at the telephone number indicated on the card to arrange a new delivery attempt. After two unsuccessful delivery attempts, the shipment will be considered "in storage" and the Customer must agree with Customer Service on a new delivery date, agreeing on any change to the delivery address. In the event that the delivery attempt following the contact of Customer Service is also unsuccessful or in the event that the Customer does not respond to the contact attempt of Customer Service, the package will be returned to OMNIA SACRA who will notify the Customer of this circumstance by email. After thirty (30) days from when the package is returned to OMNIA SACRA, the contract will be considered terminated and the purchase order cancelled pursuant to art. 1456 of the Civil Code. Once the contract has been terminated, OMNIA SACRA will proceed to refund the total amount paid by the Customer, net of the product delivery costs and any other costs. In the event that, before the expiry of the thirty days, the Customer requests to receive the purchased product again, OMNIA SACRA will proceed with the new delivery, after charging, in addition to the costs of the same, the costs of returning the product to OMNIA SACRA.

Upon delivery of the Goods, the Customer is required to check that the Goods are those ordered and do not present any faults or defects. Otherwise, he is required to communicate any problems encountered in the manner and within the terms set out in Articles 5 and 6.

  1. Omnia Sacra Gift Card

The Omnia Sacra Gift Card is issued by Omnia Sacra Srls, Via San Filippo Bianchi, 10 98122 Messina (ME)

The Omnia Sacra Gift Card allows you to purchase, exclusively at the Omnia Sacra store and the e-commerce platform at Omniasacra.com. The Omnia Sacra Gift Card cannot be used to purchase other Omnia Sacra Gift Cards. No additional cost is required for activation and use.

The Omnia Sacra Gift Card is issued and activated at the point of sale, upon payment by the customer, in cash or with other payment methods accepted by the point of sale, of an amount in any case not less than Euro 50.00 and not more than Euro 999.00. The loaded Omnia Sacra Gift Card is valid as a deductible purchase voucher and, as a legitimation title, assumes the nature of a mere financial transaction. The relative amount paid will be exempt from VAT as the transaction is configured as a transfer of money.

After activation at the point of sale with the payment of the chosen amount, the customer will be given an issuing receipt indicating the amount loaded. The amount loaded on the Omnia Sacra Gift Card does not accrue interest.

Omnia Sacra Gift Card is a bearer title and is equivalent to cash. It is not convertible into cash and cannot, under any circumstances, be returned to Omnia with a request for reimbursement of the amount loaded on it.

The Omnia Sacra Gift Card can be reused multiple times until the loaded credit runs out and in any case within one year from the date of issue indicated on the card itself. After each purchase, the credit will be automatically deducted until the loaded amount is completely used up. If the amount of the Omnia Sacra Gift Card is not sufficient to cover the amount of the purchase, it is possible to integrate its use with other forms of payment accepted at the reference point of sale.

The responsibility for the use and custody is the sole responsibility of the owner of the Omnia Sacra Gift Card. In the event of theft, loss, damage or misplacement, the Omnia Sacra Gift Card cannot be refunded by Omnia Sacra. The point of sale reserves the right to refuse any card that it suspects at its discretion to be counterfeit or photocopied.

The purchase and use of the Omnia Sacra Gift Card imply acceptance of these terms and conditions of use. Omnia Sacra reserves the right to modify and/or amend, at its sole discretion and at any time, these terms and conditions, by giving notice via email.   1. Returns and Unfulfilled Deliveries

In cases where at the time of delivery the Goods are damaged in whole or in part or are different from what was ordered or the delivery has not been made, without prejudice to the provisions of the following article 11, the Customer is required to promptly inform Customer Service in the manner set out in Article 5 within thirty days of receipt of the Goods.

In particular:

  1. Totally damaged goods: the Customer may decide at his discretion to ask OMNIA SACRA for a refund of the price paid or to request the complete replacement of the Goods, without additional costs.
  2. Partially damaged goods: the Customer may decide at his/her discretion to ask OMNIA SACRA for a refund of the price paid for the damaged goods or for the complete replacement of the damaged goods without additional costs.
  3. Goods different from those ordered: the Customer may decide at his discretion to ask OMNIA SACRA for a refund of the price paid after having returned the Goods, or the complete replacement of the Goods without additional costs or the replacement of only the different Goods without additional costs.
  4. Unfulfilled deliveries: the Customer may ask OMNIA SACRA for a full refund of the amount paid if OMNIA SACRA does not respect the delivery deadline referred to in Article 4.

In the cases provided for above, if chosen by the Customer, Omnia Sacra undertakes to refund, within thirty days, the price paid for the Order, including shipping costs.

  1. Right of Withdrawal

Without prejudice to the provisions of Article 6, the Customer has the right to withdraw from the Contract, without penalty and without costs, within 14 days of receiving the Goods by sending a simple written communication to the address INFO@OMNIASACRA.COM

The Customer who intends to withdraw from the Contract must return all the Goods to the address indicated on the invoice within 14 days from the date on which he communicated his intention to withdraw. Shipping costs are at his expense.

In case of withdrawal, the Customer has the right to obtain a refund of the price paid including any shipping costs.

  1. Intellectual Property Rights

All rights to the Site and all materials contained therein as well as to the trademarks and/or distinctive signs and/or to any and all materials or content on which intellectual, industrial or any other type of property rights exist are exclusively owned by OMNIA SACRA and/or other subjects and/or its licensors. No rights are attributed to the Customer.

  1. Guarantees

All products sold on the Site are covered by the Legal Guarantee of Conformity provided for by Legislative Decree no. 206/2005 (“Consumer Code”).

  1. Competent court

The Contract is governed by Italian law. Any dispute relating to the application, execution, interpretation and violation of the Contract will be under the jurisdiction of the Court of residence or domicile of the Customer.

  1. Other provisions. Limitations of liability

OMNIA SACRA cannot be held responsible in any way for delays in the delivery of the Goods or the failure to deliver them, if the delay or failure to deliver was caused by exceptional and unforeseeable circumstances, such as civil riots, intentional damage, fires, floods, storms or supernatural events, interruptions of an ISP or telecommunications provider, relating to the execution of the Contract.
